A declaration of war is a formal declaration issued by a national government indicating that a state of war exists between that nation, and one or more others.
Declarations of war have been acceptable means and diplomatic measures since the Renaissance, when the first formal declarations of war were issued.
Declarations of war have been phased out as a diplomatic tool since the end of the Second World War, particularly in the case of the United States. Among other reasons, this is because the legal concept of a "state of war" brings with it many logistical complications involving the established laws of war and other complex political issues.
In democratic nations, a Declaration of War customarily has to be passed by the legislature. Today, the legislature will often simply pass an "authorization for the use of force" instead. In both cases such resolutions serve to empower the national Commander in Chief to use his war powers

Uh, WRONG!!!!
Even under Geneva Convention rules a nation who wishes to DECLARE war must be under a NATIONAL FLAG, you can not declare war on terrorists who have NO FLAG, Have NO national leadership or country under which they fight so said terrorists who fight against a NATION are not subject to ANY protections under GENEVA CONVENTION if they are captured....... Because terrorists do NOT follow Geneva Convention rules.....
Such as the Muslims in IRAQ, who are, not by happen stance NATIONAL IRAQI civilians, they are PAID or often insurgents...
Since terrorist do not hold HONOR in fighting and use children as shileds , which is against Geneva convention rules and who execute without trial or jury, do NOT fight under a national flag and do NOT obey honorable "rules of engagement" are not subject to being treated under the Convention rules as prisoners of war.........
As far as it goes if a terrorist child or grown-up stands to raise knife to throat, gun in hand to strike down ANY person, I say take them out.....
You have 8 year old MUSLIM CHILDREN trying to cut the throat of a MARINE NURSE who was trying to help deliver his OWN brother into the world.......
You have OTHER Muslims who are IRAQI useing the very same terrorist tactics against the terrorists fighting the US troops...... Kinda funny you do not hear much of that by media but by troops fighting in IRAQ itself.....
